CONDITIONS OF CONTRACT
1. THE BREEDER OF THIS BITCH ATTESTS TO THE
FOLLOWING: THAT I AM THE OWNER OF THIS BITCH AND HAVE EVERY LEGAL
RIGHT TO BREED HER TO THE STUD OF MY CHOOSING. THAT SHE IS AT
LEAST 22 MONTHS OF AGE AND LESS THAN 6 YEARS OF AGE. THAT SHE HAS BEEN
CHECKED BY A VET AND FOUND TO BE IN BREEDING CONDITION AND FREE OF ANY
GENETIC DEFECTS. THAT I WILL PROVIDE WHATEVER IS NECESSARY, GOOD DIET,
WATER, SHELTER AND VETERINARY CARE TO ASSURE THE SUCCESS AND
WELL-BEING OF THIS BITCH AND HER PUPPIES DURING ALL STAGES OF
GESTATION AND WHELP OF THE LITTER. ALSO THAT THIS BITCH HAS NOT
PRODUCED A LITTER LARGER THAN TWO PUPS IN THE LAST 12 MONTHS.
2. THE OWNER OF SAID BITCH AGREES TO PAY THE
SUM OF ( $2500.00) TWO THOUSAND, FIVE HUNDRED DOLLARS FOR THE SERVICES OF THE
AFOREMENTIONED STUD. A NON-REFUNDABLE FEE OF TWO HUNDRED DOLLARS
($200.00) IS TO BE PAID TO STUD DOG OWNER PRIOR TO BREEDING TAKING
PLACE TO COVER EXPENSES OF TRAVEL AND LOSS OF WORK DURING THE BREEDING
PROCESS. THE STUD FEE IS TO BE PAID WHEN LITTER REACHES FOUR (4)
WEEKS OF AGE AND BEFORE REGISTRATION PAPERS ARE SIGNED. UNLESS OTHER
ARRANGEMENTS HAVE BEEN AGREED UPON BY BOTH PARTIES.
THIS IS FOR SERVICES RENDERED AND GUARANTEES A
REPEAT BREEDING SHOULD SAID BITCH NOT BECOME PREGNANT. HOWEVER, THIS
RESERVES THE STUD FOR ONLY ONE ADDITIONAL BREEDING IN THIS EVENT.
SHOULD THE SECOND BREEDING ALSO NOT PRODUCE ANY OFFSPRING THEN THE
CONTRACT BECOMES NULL AND VOID.
3.TWO (2) LIVE WHELP CONSTITUTES A LITTER.
SHOULD THERE BE ONLY ONE LIVE WHELP THE STUD DOG OWNER AGREES TO
ACCEPT HALF THE STUD FEE OF ($1250.00 ) ONE THOUSAND, TWO
HUNDRED FIFTY DOLLARS. IN THE
EVENT THAT ANY PUPPY DIES AFTER BEING SOLD OR AFTER REACHING 4 WEEKS
OF AGE, OR IF ANY PUPPY IS RETURNED FOR ANY REASON, THIS STILL
CONSTITUTES A COMPLETED STUD SERVICE AND STUD DOG OWNER SHALL BE PAID
IN FULL AS PER ABOVE AGREEMENT. ALSO THERE WILL BE NO LIABILITY TO
THE STUD DOG OWNER.
4. ANY AND ALL EXPENSES FOR THE BREEDING OF
THIS BITCH ARE THE SOLE RESPONSIBILITY OF THE BITCH OWNER. SUCH AS:
COLLECTION AND SHIPPING OF SEMEN AS WELL AS PROGESTERONE OR ANY OTHER
TESTING ETC.
5. SHOULD THE OWNER OF THE STUD DOG CHOOSE TO
ACCEPT A PICK PUPPY IN PLACE OF A CASH STUD FEE, STUD OWNER SHALL MAKE
THE SELECTION OF SAID PUPPY AT THE AGE OF EIGHT WEEKS. UNTIL THE TIME
THIS CHOICE IS MADE NO PUPPY SHALL BE SOLD, GIVEN AWAY OR PROMISED
FROM THIS LITTER. AT WHICH TIME THE STUD OWNER AGREES TO RETURN ALL
CASH FEES PAID HEREIN (NOT INCLUDING THE EXPENSE FEE) TO THE BITCH
OWNER FOR EXCHANGE OF PICK PUPPY.
IF AGREED UPON BY BOTH PARTIES THE PICK
PUPPY MAY BE KEPT BY THE BREEDER OF THE LITTER AND THE PICK OPPOSITE
SEX PUPPY SUBSTITUTED TO THE STUD OWNER. AT WHICH TIME THE SAME REFUND
WOULD APPLY AS PREVIOUSLY DISCUSSED.
STUD DOG OWNER SHALL HAVE THE EXCLUSIVE
RIGHT TO USE THEIR KENNEL NAME ON PICK PUPPY AND MAY OR MAY NOT CHOOSE
TO USE THE NAME OF THE BITCHES KENNEL NAME.
SHOULD THE STUD DOG OWNER DECIDE TO SELL
OR PLACE THIS PUPPY, THEY WILL GIVE ALL PERTINENT INFORMATION AS TO
THE PLACEMENT OF THIS PUPPY TO THE BITCH OWNER AS WELL AS THE OPTION
TO BUY THE PUPPY AT THE ORIGINAL AGREED UPON STUD PRICE.
6. THE BITCH OWNER OF THIS LITTER DOES AGREE
NOT TO SELL OR PLACE THE PUPPIES RESULTING FROM THIS BREEDING IN OR TO
ANY OF THE FOLLOWING:
* ALLOW ANY PUPPY TO BE PLACED IN A
SHELTER OR POUND.
* A THIRD PARTY KNOWINGLY INTENDING TO
RESELL SAID PUPPY.
*ANY LABORATORY FOR EXPERIMENTATION.
*ANY KNOWN OWNER OF A PUPPY MILL OR OF A
SUSPECTED PUPPY MILL.
* ANY PET SHOP OR PUPPY BROKER.
*ANYONE WHO INTENDS TO BREED ANY BITCH
PUPPY EVERY SEASON, THEREBY PRODUCING MORE THAN THREE LITTERS IN A 2
YEAR PERIOD.
* ANYONE WISHING TO BUY A PUPPY FOR THE
PURPOSE OF CREATING A TEMPERAMENT THAT IS VICIOUS OR CONTRARY TO THE
NATURAL TEMPERAMENT OF THE BREED...THAT OF A GENTLE GIANT!
THE BITCH OWNER DOES ALSO AGREE TO MAKE
AVAILABLE TO THE STUD DOG OWNER THE NAMES AND ADDRESSES OF ANY AND ALL
PERSONS WHO RECEIVE ONE OF THE PUPPIES FROM THIS LITTER, THAT THE STUD
DOG OWNER CAN KEEP TRACK OF THE PROGRESS AND DEVELOPMENT OF WHAT THEY
HAVE PRODUCED AND THE WELFARE OF THE LITTER.
4/ THIS CONTRACT IS WRITTEN FOR THE
PROTECTION AND WELFARE OF ALL PARTIES CONCERNED BUT ALSO FOR THE
PUPPIES THAT MAY RESULT FROM THIS BREEDING. IT IS THE RESPONSIBILITY
OF BOTH PARTIES WHO BRING NEW LIFE INTO THE WORLD TO DO ALL WE CAN TO
ASSURE A HAPPY HEALTHY LITTER WITH LOVING HOMES. I AM HAPPY TO SHARE
THIS VENTURE AND HELP MAINTAIN ALL THAT OUR DOGS HAVE TO OFFER THE
NEXT GENERATION.
I/WE THE UNDERSIGNED, HAVING THOROUGHLY READ
AND UNDERSTOOD THE CONTENTS OF THIS CONTRACT AGREE THAT IT IS A LEGAL
AND BINDING AGREEMENT. BY SIGNING THIS CONTRACT I/WE DO AGREE TO
ADHERE TO THE CONTENTS , IT’S TERMS AND CONDITIONS. TO FAIL TO DO SO
WILL BE CONSIDERED A BREACH OF CONTRACT AND THEREFORE CAUSE
RESTITUTION TO BE MADE TO STUD DOG OWNER FOR ANY DEFAMATION OF
CHARACTER TO THIS KENNEL NAME AND/OR THE REPUTATION OF THE SAID
OWNERS.

Sales Agreement and Guarantee
We,
David or Melody Fuller do hereby sell and transfer this day
_____________________for
the sum of _________________

mastiff puppy. From the breeding of:

Ownership of
this dog shall be in the name of :

AKC registration
papers shall be forwarded to the buyer as quickly as possible after
payment in full has been made to the breeder. Also, payment must
be in cash or certified check or money order and must be received
before AKC papers can be sent to the buyer or puppy can be picked up.
Buyer agrees to contact
Breeder with any change of address or telephone number during the life
of said mastiff puppy. The buyer also agrees to use the name
FANTASY first in the registered name of this dog. If puppy is to
be shipped, all costs of shipping are incurred by the Buyer, including
the crate.
The buyer also
agrees to register the pup's microchip # with the AKC
within 60 days of
recieving the puppy. The buyer agrees to send a copy of the AKC
registration certificate and microchip registration certificate within
30 days of reciept from the AKC. The buyer agrees that at no time
shall this puppy be registered with any other canine registration
service other than the AKC (American Kennel Club) or Canadian Kennel
Club. Violation of this part of the contract shall void any/all
warrantees. Violation of this clause shall also be pursued in a court
of law. (Buyers' initials:___________________)
1/ This puppy
must be examined by a veterinarian within 5 days of purchase. If a vet
should find this puppy to be in poor health or to have any
genetic/medical disabilities, that will result in poor quality of
life, or excessive medical expences, the buyer will be refunded the
full purchase price of said pup (if any) provided that: 1. The puppy
and the AKC papers are returned to the breeder within 10 days of
purchase; 2. A letter from the examining vet stating the exact
illness or defect is presented to the breeder prior to the return of
the puppy and can be confirmed by a second veterinary examination ( at
the breeders expense ) by a vet agreed upon by both parties.
2/ This puppy
must be fed a high quality large breed dog food for the first
two years. We suggest ___________________________________ This food
has the correct protein levels for optimum growth and contain no soy
which can cause BLOAT. Puppy must not be allowed to become overweight
which can cause permanent damage to structure and health. Puppy must
receive only moderate supervised exercise for the first year to then
be increased gradually, since improper exercise could damage bone
structure. Should these guidelines not be adhered to any health
guarantee becomes null and void.
3/ Any puppy bought
for showing/breeding purposes will be co-owned by breeder until said
puppy achieves his/her championship stutus. Once this requirement is
met, breeder shall sign off as co-owner. As co-owner, breeder has no
obligation for veterinary costs, show costs, feeding costs, and/or
liabilities. Any male puppy used at stud must have health testing in
place prior to breeding and any female puppy must have achieved her
championship first and health testing completed. Breeder reserves the
right of stud service of the male, all costs of collection incurred by
the breeder. If Buyer opts to neuter male, Breeder must give
authorization to do so, or Breeder shall be reimbursed one-half the
purchase price of said puppy for loss of breeding rights. Any pup
purchased as "a pet" will be sold with a limited registration AKC
certificate and shall be neutered between 15 mos. and two years. This
clause is to discourage "backyard breeders" from bringing mastiff
puppies into an already over-populated world. The co-ownership clause
also encourages education and responsibility through showing your dog
through championship status before buyer may breed his/her bitch and
produce a litter.
4/ This dog is
guaranteed from crippling hip dysplasia for a period of 26 mo. (2
yrs.+ 2 mos.) At the age of 2 yrs., the dog is to undergo a physical
exam ( Penn-Hip or OFA x-ray ) to determine the soundness of the dogs
hips by a certified vet. If after this exam the dog experiences any
crippling effects, the buyer must send a copy of the OFA or Penn-Hip
report to the breeder. At this time the buyer may request a
replacement puppy from the next available litter, or recieve one-half
the purchase price of said puppy. The owner may at their disgression
keep the existing puppy or return it to me (the breeder).

This puppy is
also guaranteed against any inherited eye condition that would result
in early blindness. By the age of 25 mo.. the dog must be examined by
a board certified veterinarian of ophthalmology. Should it be
determined the dog has an inherent eye disease, a letter must be
provided to the breeder from the ophthalmologist stating that the dog
will definitely lose its sight at an age that is not a result
of old age. If this is confirmed, the dog in question must be
spayed/neutered or after contacting me, to discuss options, at the
owners disgression, euthanized. A letter from the vet stating that
the dog was spayed/neutered or euthanized must then be presented to
the breeder. The owner may then request a replacement puppy from the
next available litter or recieve one-half the purchase price of said
puppy.
This puppy is not guaranteed against:
1.
H.O.D.
2.
O.C.D.
3.
Panostitis ( pano )
4.
Any non-genetic disease.
Bone ailments can be a
result of poor nutrition, over feeding, over supplementing and/or
excessive over exercising. PLEASE, remember that a mastiff puppy grows
very quickly and carries a lot of weight while very young. Your puppy
may look like an adult but it is a puppy and needs puppy care. While
your puppy does need to stretch his legs, it does not take much to
tire him out. Do not take your puppy jogging, hiking or for long
walks.
6/ Do not make
them climb steps unaided until they are 5 months old. Exercise should
be slow and minimal until they are 14 months old. Always supervise
your puppy when playing with other dogs; remember, you would not let
an infant play football with a 12 yr. old. Even though your puppy may
seem large, his bones and joints are very young and developing. Most
structure damage is done within the first 18 months of a puppy’s life.
It is much better to play with a squeaky toy or tug rope than getting
overly rough. Always choose a toy that is large enough; even a young
mastiff has a mouth and throat large enough to swallow most small toys
and bones. These are large dogs and it is important not to just look
at the PUPPY you have today but at the DOG he will be when full grown.
NEVER teach your puppy to do anything you would not want him to do as
a 200lb. Adult! Training is important and it is required that this
puppy be taken to a puppy kindergarten or puppy obedience class for
proper training and socialization. Mastiffs are "indoor dogs" and must
be kept in the home. No mastiff should be chained outside. Provide a
fenced or partial-fenced yard for your puppy. Your mastiff must NOT be
allowed to roam at large. Your mastiff must travel in an enclosed
vehicle and not be permitted to travel in an open-bed pick-up truck.
7/ If at any time
it is determined that this dog is being neglected, abused or raised in
a manner that would be detrimental to its well being or may create a
vicious dog, the breeder has the legal right to come onto the owners
property and rescue the dog from said conditions.This care would be a
breach of contract and the dog will be repossessed The owner would
not receive any compensation for the loss of the dog and all
ownership of said animal shall
revert back to the
breeder. In such a case, all authorities would be notified and
appropriate prosecution would be brought against all responsible
parties.
8/ When you buy
this puppy you agree to provide the best possible care for it.
Remember, a well trained dog is always a joy to everyone who knows it.
9/ Lastly, if for
whatever reason you find that you cannot keep or do not
want this dog you must contact us, the breeder (David & Melody
Fuller) so said dog can be returned to said breeder. AKC registration
will be transferred back to the Breeder(s). Should we be able to
re-sell said dog the owner would receive any funds received by us
minus any expenses incurred while maintaining the dog until being
rehomed. However, should I simply have to find a loving home with no
moneys exchanged the owners or breeder shall receive no refunds. We
brought this dog into the world through selective breeding and you
took this dog into your home; we are both responsible to do all we can
to give him a safe, healthy, happy and loving home for life. If it is
impossible to return the dog to us, through our deaths then the dog
must be returned to the Mastiff Club of America’s Mastiff Rescue.
The buyer and
seller by affixing their names here on this
